Judicial guarantees for the protection of political rights (the role of the Iraqi Federal Supreme Court as a sample)

The topic we addressed in this study is judicial guarantees for the protection of political rights, in which we used the analytical approach. In this study, we will focus on the role of the Federal Supreme Court in Iraq in protecting its political rights. For this purpose, we will analyze the decisions issued by this court from a legal perspective, the extent of its impartiality, and whether these decisions are compatible with the laws and constitutions or were issued against the laws and constitutions. The Federal Supreme Court seeks to protect political rights by monitoring the constitutionality of laws, especially those related to political rights. Among the most important decisions issued by the court was the decision to cancel the law extending the mandate of the Kurdistan Regional Parliament and the decision to dissolve the Kurdistan Region’s governorate councils. Other decisions of the court included the unconstitutionality of the referendum held in the Kurdistan Region on 9/25/2017, and many other decisions it issued to protect political rights.
