Withdrawal of illegal administrative decisions Comparative study of Egyptian and Iraqi laws

In this study, the concept of withdrawal, its nature, and its legal basis have been examined. The research explores various cases of administrative decisions’ withdrawal, the conditions required for withdrawal, and elucidate the jurisprudential perspectives and judicial trends concerning this theory in both Egypt and Iraqi laws. Additionally, the paper investigates the presidential authority in relation to withdrawal of administrative decisions. The findings of the research reveal that the withdrawal of such decisions hinges on the fulfillment of two crucial conditions: firstly, the decision must be defective in terms of legality, and secondly, the withdrawal process must adhere to the prescribed deadlines as per Egyptian and French law.
