Abstract

The Prophet's Hadith that says A people who make a woman their ruler will never be successful, was an argument against women from holding positions and public affairs in ancient Islamic jurisprudence as well as modernity, But in the modern era, many women have been able to take power and succeed in public affairs and state administration, It is necessary to review the inherited comprehension, of this prophetic speech in the light of the rules of text analysis. In this endeavor, this research confirms that this prophetic text does not have a legislative status, because it is issued by the Prophet In a non-legislative context.
