This study explores the role of the International Administrative Court in safeguarding the rights of international employees, focusing on the internal justice system of the United Nations. Using an analytical approach, we define the concept of an international employee and examine their rights and duties.
The primary issue addressed in this study is the legal status of international employees and the guarantees that protect their rights and obligations within the framework of international administrative law. International employees are entitled to several key rights, including financial benefits, international protection, and recognition of their international status. At the same time, they are bound by obligations such as adherence to the laws and guidelines of their respective organizations, loyalty to the institution, protection of professional confidentiality, and maintaining honesty, integrity, independence, and impartiality in their duties. Most international organizations have internal administrative courts that employees can turn to in case of rights violations. The United Nations, in particular, has an internal judicial system comprising two Administrative Tribunals and an Appeals Court, providing legal recourse for employees affected by administrative decisions.
To strengthen the protection of international employees’ rights on a global scale, it is essential to establish an International Administrative Tribunal and develop a unified international administrative law governing the civil service of international employees through a binding international agreement.
