Legal empowerment of individuals before constitutional courts and their role in achieving social justice: a comparative study

Recognizing the right to social justice within a country's constitution and laws constitutes a fundamental guarantee for promoting individual rights and freedoms. This recognition elevates social justice from being merely a political objective to a legally protected right, providing the essential foundation for judicial recourse against public authorities and ensuring its protection through the judicial system. While the concept of social justice is clearly defined within legislation, its realization requires continuous efforts to address contemporary challenges such as poverty, unemployment, inadequate housing, and homelessness. This necessitates guaranteeing the right to access justice to challenge laws or decisions that infringe upon social justice rights as part of human rights.
