Abstract

The Kurdistan Region is legally recognized as a region under the new Iraqi Federal Constitution of 2005, giving it the right to have its own constitution. Several attempts have been made at the highest levels since 2005 to draft a constitution, but the Kurdistan Region has not yet been able to draft its own constitution, which has its own consequences. The primary objective of this study is to shed light on the steps, opportunities, and challenges involved in drafting a constitution for the Kurdistan Region. Within the framework of research theory related to the issue of the constitution, the efforts to write the constitution, the opportunities and challenges facing the writing of the constitution in the Kurdistan Region are presented. In presenting the content of the research, we adopted the descriptive-analytical approach, and the historical approach as a framework for the research methodology. Although the Kurdistan Region enjoyed political authority before 2003, it was not possible to draft a constitution due to the internal situation and political instability.
